Mediterranean diet ???

International organizations and governments are now more or less agreed we have an epidemic of obesity so, for the research community, the big question is which diet to recommend. Note the “recommend”. There’s no willingness in any government to try forcing a change in what we eat. The best first step is to recommend the most effective diet based on the best available evidence. There are a number to choose from under the general headings of low-carb, high-protein, high-fat diets. The problem with much of the current evidence is the small number of people enrolled in short-term trials. To be able to make general statements, there should be a statistically significant number of participants and the trials should last a reasonable period of time for the full effects to be measured. With dieting there’s also the problem that up to half the participants drop out of most trials. Just published is a new trial that lasted for two years. Called DIRECT (Dietary Intervention Randomized Controlled Test), it compared a Mediterranean, calorie-restricted diet based on the Harvard Medical School guide to healthy eating; a low-fat, calorie-restricted diet based on the American Heart Association’s guidelines; and a low-carb, non-restricted-calorie diet based on Atkins. The participants were aged between 40 and 65 and had a BMI of at least 27, or an existing diagnosis of diabetes or heart disease. The average was people with a BMI of 31 with 86% men. Over two years, 90% stayed with the low-fat diet, 85% with the Mediterranean diet, and 78% with the low-carb diet. Weight was lost consistently in the first six months, with the new weight then stabilizing. Those in the low-fat group lost the least weight with the loss by the Mediterranean and low-carb groups broadly similar with participants dropping two BMI levels. Everyone lost about 2 inches in waist circumference. But the Mediterranean and low-carb diets showed good reductions in blood pressure and improvements in metabolic effects making them the preferred approaches, i.e. there were real, measurable health benefits and not just weight loss. The recommendation is therefore for doctors or nutritionists to discuss dieting preferences with you, aiming to agree a strategy suited to your tastes. If selecting the diet, it may be that an Atkins approach is best for those who find it difficult to restrict their calorie intake. No one should approach this decision with closed minds. It’s a case of starting with one program and then varying it to find the combination of foods you find easiest to accept for the long-term where the greatest health benefits are earned. Acomplia is a useful addition to the program. In clinical trials, it also performed well, helping participants lose an average 10% of their body weight. With the right diet, a little additional exercise, and Acomplia in support, there’s no reason why you should not break the two-year barrier and go on to an increasingly healthy future life. While your lifestyle factors such as smoking, alcohol intake, or spicy food intake can worse the symptoms of your GERD, research has not found them to be actual causes of acid reflux. You can alleviate some of your symptoms by decreasing these lifestyle choices, by eating many small meals rather than large ones, and avoiding food before bed time, a time when acid likes to accumulate. There are a wide variety of methodsfor treatment of acid reflux , and you can use at home remedies, over the counter remedies, or prescription treatments such as Aciphex. Over the counter remedies will assist you in controlling your acid throughout the day, and provide comfort from your primary symptoms. You also want to ease up on some of your lifestyle factors, and avoid eating around time frames where you will be lying down for long periods. Avoiding fatty and fried foods will also work towards controlling acid. Look online for others who are selling the same car, see what they are going for. Take a look at auctions, visit one if necessary, to see what people are willing to pay. Researching a multitude of places will give you the best idea, before going in, on what the dealer will offer you.

Protecting Your Domain Name: Understanding the Anti-Cybersquatting Consumer Protection Act

Despite the simple functionality on many levels of a domain name, it is vital to the success of an online business enterprise. At its heart, a domain name essentially is an address that tells a user of the Internet how to find a particular website. In many instances, the owners of trade or service marks use their marks as part of their business domain names. Nonetheless, there are many instances in which someone else may take advantage and start using the trade or service mark as part of another domain name. With this well in mind, it is incumbent upon trade and service mark owners to monitor to make certain that others are not misusing their intellectual property in the registration of other domain names.

No matter how the domain name usage actually is discovered, trade or service mark owners have two basic options for resolving disputes over domain names. First, a person or company can take action under the Uniform Domain Name Dispute Policy. The benefits of this process is that it is relatively fast and relative inexpensive. There are drawbacks that include the fact that this process is not available to all domain names, it is not appropriate for license disputes and damages and attorney fees cannot be recovered through this process.

The other alternative available to a person or company who believes it has been wronged or violated in terms of a domain name related issue is the Anti-Cybersquatting Consumer Protection Act (“ACPA”). The ACPA was enacted in 1999 and was designed to prevent cybersquatting on the Internet.

Cybersquatting generally is considered the use of domain names that are confusingly similar to trademarks and service marks owned by other business enterprises or individuals.

The ACPA can impose liability on the registrant of such a domain name (or its licensee) if that person or entity has done the following:

(i) has a bad faith intent to profit from the mark; and,

(ii) registers, traffics in, or uses a domain name that is identical or confusingly similar to the mark and the mark (or dilutive if the mark is famous) was distinctive (or famous) at the time of the domain name registration.

The ACPA does establish a set of nine nonexclusive factors that a court may utilize in working to determining whether a person or entity has acted in bad faith, has a bad intent, in regard to a domain name registration. The ACPA states that “Bad faith intent . . . shall not be found in any case in which the court determines that the person believed and had reasonable grounds to believe that the use of the domain name was a fair use or otherwise lawful.”

For example, the actual trade or service mark owner must demonstrate that the challenged domain name is confusingly similar to its own trade or service mark. Only the challenged domain name and the trade or service mark will be compared under the ACPA. According to the ACPA, the proper inquiry is whether the defendant’s domain name is so similar to the plaintiff’s trade or service mark that the two could be confused by a third party.

If the mark owner is successful in the action, the court may order the forfeiture, cancellation or transfer of the domain name. Moreover, the mark owner may recover the defendant’s profits, any damages sustained by the owner of the trademark and its costs of the action.

Pursuant to the statute, the owner of the mark may elect to recover statutory damages, in lieu of actual damages and profits. The court can award statutory damages in an amount between $1,000 and $100,000 per domain name.

Claims that are made under the ACPA and UDRP are two options available to trade and service mark owners who are trying to protect their mark from being used by others in bad faith.
